Please read these terms carefully before renting a vehicle from Valero.

Acceptance of Terms

By booking, reserving, or renting a vehicle from Valero Exotics Exotic Car Rentals ("Valero," "we," "us," or "our"), you ("Renter," "you," or "your") agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Valero. If you do not agree with any part of these terms, you must not use our services or rent a vehicle from us.

These Terms and Conditions supplement and are in addition to any rental agreement you sign at the time of vehicle pickup. In the event of a conflict between these Terms and Conditions and the rental agreement, the rental agreement shall prevail.

Rental Eligibility

To rent a vehicle from Valero, you must meet the following requirements:

  • Age Requirement: You must be at least 25 years of age at the time of rental. Valid government-issued photo identification is required to verify your age.
  • Valid Driver's License: You must possess a valid, unrestricted driver's license issued in the United States or an International Driving Permit accompanied by a valid foreign license. Your license must have been held for a minimum of 2 years. Temporary, learner's, or restricted permits are not accepted.
  • Insurance: You must provide proof of full-coverage automobile insurance that extends to rental vehicles, including comprehensive and collision coverage with a minimum coverage of $100,000. Your insurance must cover exotic and luxury vehicles. If your policy does not cover rental vehicles or exotic cars, you must purchase supplemental coverage through Valero or an approved third-party provider before the rental period begins.
  • Clean Driving Record: Valero reserves the right to deny rental to any individual with a history of DUI/DWI convictions, reckless driving charges, or excessive moving violations within the past 5 years.
  • Credit Card: You must have a valid major credit card (Visa, Mastercard, or American Express) in your name for payment and security deposit purposes. Debit cards, prepaid cards, and cash are not accepted for security deposits.

Valero reserves the right to refuse service to anyone who does not meet these eligibility requirements or for any other reason at our sole discretion.

Booking and Reservations

Reservations can be made through our website, by phone at (347) 477-3428, or by email at info@valeroexotics.com. All reservations are subject to vehicle availability.

  • A reservation is not confirmed until you receive a written confirmation from Valero and the required deposit has been processed.
  • Valero reserves the right to substitute a vehicle of equal or greater value if the reserved vehicle becomes unavailable due to unforeseen circumstances.
  • You must provide accurate and complete information when making a reservation. Providing false or misleading information may result in cancellation of your reservation and forfeiture of any deposits paid.
  • For same-day or next-day bookings, additional verification steps may be required.
  • Rental periods are calculated in 24-hour increments. Late returns may be subject to additional daily rental charges.

Pricing and Payment

All prices listed on our website and promotional materials are in US Dollars and are subject to change without notice. Pricing does not include applicable taxes, fees, surcharges, or optional add-ons unless explicitly stated.

  • Rental Rates: Daily rental rates vary by vehicle and season. Weekend, holiday, and peak-season rates may apply. The rate confirmed at the time of booking is the rate you will be charged.
  • Additional Fees: Additional charges may apply for delivery/pickup services, additional drivers, late returns, excessive mileage, tolls, traffic violations, fuel replacement, cleaning fees, and any other services or charges outlined in your rental agreement.
  • Payment: Full payment for the rental period is due at the time of vehicle pickup unless other arrangements have been made in advance. We accept Visa, Mastercard, American Express, wire transfers, and certified checks (received at least 5 business days before the rental start date).
  • Taxes: All rentals are subject to applicable state and local sales tax, and any other government-imposed fees or surcharges.

Security Deposit

A security deposit is required for all rentals and will be placed as a hold on your credit card at the time of vehicle pickup.

  • Deposit Amount: Security deposits range from $2,500 to $10,000 depending on the vehicle rented. The specific deposit amount for your rental will be communicated at the time of booking and confirmed before vehicle pickup.
  • Hold Duration: The security deposit hold will be released within 7 to 14 business days after the vehicle is returned in satisfactory condition, subject to inspection.
  • Deductions: Valero reserves the right to deduct from the security deposit any amounts owed for damage, excessive wear, cleaning fees, fuel replacement, traffic or parking violations, toll charges, late return fees, excess mileage charges, or any other charges arising from your rental.
  • Insufficient Deposit: If charges exceed the security deposit amount, you are responsible for paying the remaining balance. Valero reserves the right to charge your credit card on file for any outstanding amounts.

Vehicle Use Restrictions

When renting a vehicle from Valero, you agree to the following use restrictions. Violation of any of these restrictions may result in immediate termination of your rental, forfeiture of your security deposit, and liability for all resulting damages and costs:

  • No Racing or Track Use: Vehicles may not be used for racing, speed testing, track events, rallies, or any form of competitive driving.
  • No Sub-Letting: You may not sub-rent, lend, or otherwise allow any unauthorized person to operate the vehicle. Only drivers listed on the rental agreement are authorized to drive.
  • No Smoking: All Valero vehicles are strictly non-smoking. This includes cigarettes, cigars, vaping devices, and any other smoking products. A minimum cleaning fee of $500 will be charged for any evidence of smoking in the vehicle.
  • No Off-Road Use: Vehicles must be operated only on paved, maintained roads. Off-road driving, driving on beaches, or driving on unpaved surfaces is strictly prohibited.
  • Geographic Restrictions: Unless otherwise agreed in writing, vehicles must remain within the state of New York and the tri-state area (New York, New Jersey, Connecticut). Taking the vehicle outside the approved area without prior authorization will result in additional charges and may void all insurance coverage.
  • Legal Use Only: Vehicles must be operated in compliance with all applicable traffic laws and regulations. You are responsible for all traffic violations, parking tickets, and toll charges incurred during your rental period.
  • No Towing: Vehicles may not be used to tow or push any other vehicle or object.
  • No Vehicle Modifications: You may not modify, alter, or add any accessories or equipment to the vehicle without prior written consent from Valero.
  • Passenger Limits: You must not exceed the vehicle's stated passenger capacity.
  • No Pets: Pets are not permitted in Valero vehicles unless prior written approval is obtained. A minimum cleaning fee of $350 applies if pet hair or odor is detected.

Insurance Requirements

Adequate insurance coverage is mandatory for all Valero rentals:

  • You must carry full-coverage automobile insurance that extends to exotic and luxury rental vehicles, including comprehensive and collision coverage with a minimum of $100,000 in coverage.
  • You must provide a copy of your insurance policy or declaration page before or at the time of vehicle pickup.
  • Valero reserves the right to verify your insurance coverage with your insurance provider.
  • If your insurance does not adequately cover the rental vehicle, you must purchase supplemental coverage before the rental begins.
  • In the event of an accident or damage, your insurance will be the primary coverage. You are responsible for all deductibles and any amounts not covered by your insurance.
  • Failure to maintain adequate insurance during the rental period is a material breach of these terms and may result in immediate termination of your rental.

Damage and Liability

You are fully responsible for the rental vehicle from the time of pickup until it is returned to and inspected by Valero:

  • Pre-Rental Inspection: A thorough vehicle inspection will be conducted at pickup with photographic documentation. You are encouraged to note any pre-existing damage before accepting the vehicle.
  • Post-Rental Inspection: A post-rental inspection will be performed upon return. Any new damage discovered will be documented and charged to the renter.
  • Damage Responsibility: You are responsible for all damage to the vehicle during your rental period, regardless of fault, including but not limited to collision damage, vandalism, theft, weather damage, curb rash on wheels, tire damage, interior damage, and mechanical damage caused by misuse.
  • Repair Costs: Damage repairs will be performed at an authorized dealership or approved body shop. You are responsible for the full cost of repairs, including parts, labor, and any diminished value to the vehicle.
  • Loss of Use: In addition to repair costs, you may be charged for loss of rental income during the time the vehicle is being repaired and is unavailable for rent.
  • Total Loss: In the event of a total loss, you are responsible for the full market value of the vehicle less any insurance proceeds received.
  • Accident Reporting: You must report any accident, damage, or theft to Valero immediately and to local law enforcement within 24 hours. Failure to report promptly may void insurance coverage and result in additional liability.

Cancellation Policy

Valero's cancellation policy is as follows:

  • 48+ Hours Before Rental: Cancellations made at least 48 hours before the scheduled pickup time will receive a full refund.
  • 24-48 Hours Before Rental: Cancellations made between 24 and 48 hours before the scheduled pickup time will receive a 50% refund.
  • Less Than 24 Hours: Cancellations made less than 24 hours before the scheduled pickup time are non-refundable.
  • No-Shows: Failure to pick up the vehicle at the scheduled time without prior notice will be treated as a cancellation with no refund.
  • Early Returns: No refunds will be issued for early returns or unused rental days.
  • Valero Cancellations: In the rare event that Valero must cancel a reservation due to vehicle unavailability or other circumstances beyond our control, you will receive a full refund or the option to reschedule.

All refunds will be processed to the original payment method within 7-10 business days.

Mileage Policy

Each rental includes a mileage allowance as follows:

  • Daily Allowance: 150 miles per day are included with each rental.
  • Excess Mileage: Miles driven beyond the included allowance will be charged at a per-mile rate that varies by vehicle. The excess mileage rate will be specified in your rental agreement, typically ranging from $2 to $10 per mile depending on the vehicle.
  • Mileage Tracking: Mileage is recorded from the vehicle's odometer at pickup and return. GPS tracking may also be used to verify mileage.
  • Extended Mileage Packages: Additional mileage packages may be purchased at the time of booking for a discounted rate. Please inquire about available mileage packages when making your reservation.
  • Weekly and Monthly Rentals: Special mileage allowances may apply for weekly (7+ days) and monthly (30+ days) rentals. Contact us for details.

Delivery and Pickup

Valero offers delivery and pickup services for your convenience:

  • Standard Delivery: We offer delivery and pickup throughout the New York City metropolitan area, Long Island, The Hamptons, and parts of New Jersey and Connecticut.
  • Delivery Fees: Delivery and pickup fees vary based on distance from our facility. Fees will be quoted at the time of booking.
  • Delivery Time: You must be present at the delivery location at the agreed-upon time with all required documents and payment. A 30-minute grace period will be provided, after which additional waiting charges may apply.
  • Facility Pickup: You may also pick up and return vehicles at our Long Island, NY location at no additional charge.
  • Vehicle Return: The vehicle must be returned at the agreed-upon date, time, and location. Late returns will be charged at the daily rental rate plus a $100 late fee. Returns more than 2 hours late without prior approval will be charged an additional full day.
  • Fuel: Vehicles are provided with a full tank of fuel and must be returned with a full tank. If the vehicle is returned with less than a full tank, you will be charged for fuel replacement at a rate of $12 per gallon plus a $50 refueling service fee.
  • Cleanliness: Vehicles must be returned in a reasonably clean condition. Excessive dirt, stains, odors, or debris may result in a cleaning fee of up to $500.

Prohibited Activities

The following activities are strictly prohibited and will result in immediate termination of your rental, forfeiture of your security deposit, and potential legal action:

  • Operating the vehicle under the influence of alcohol, drugs, or any impairing substance
  • Using the vehicle for any illegal purpose or activity
  • Using the vehicle for hire, including ride-sharing services (Uber, Lyft, etc.), limousine services, or any commercial purpose
  • Participating in any form of racing, speed contest, or reckless driving
  • Transporting hazardous materials, explosives, or illegal substances
  • Removing, disabling, or tampering with any GPS tracking device, dashboard camera, or other monitoring equipment installed in the vehicle
  • Using the vehicle to transport more passengers than the vehicle's rated capacity
  • Operating the vehicle outside of the approved geographic area without prior written consent
  • Any action that would void the vehicle's warranty or insurance coverage

Indemnification

You agree to indemnify, defend, and hold harmless Valero Exotics Exotic Car Rentals, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the rental vehicle
  • Any violation of these Terms and Conditions or the rental agreement
  • Any accident, injury, or property damage occurring during your rental period
  • Any traffic violations, parking tickets, toll charges, or fines incurred during your rental
  • Any misrepresentation or breach of warranty made by you
  • Any claim by a third party related to your use of the vehicle

This indemnification obligation shall survive the termination of your rental agreement.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • Valero shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your rental, including but not limited to loss of income, loss of business, loss of data, or personal injury not caused by Valero's gross negligence.
  • Valero's total liability for any claim arising from or related to your rental shall not exceed the total rental fees paid by you for the applicable rental period.
  • Valero is not responsible for personal property left in the vehicle. We recommend removing all personal belongings before returning the vehicle.
  • Valero is not liable for delays, cancellations, or service interruptions caused by weather, natural disasters, mechanical breakdowns, government actions, or other events beyond our reasonable control.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms or your rental shall be subject to the exclusive jurisdiction of the state and federal courts located in Suffolk County, New York.

Before initiating any legal proceeding, you agree to first attempt to resolve the dispute informally by contacting Valero at info@valeroexotics.com. If the dispute cannot be resolved informally within 30 days, either party may proceed with formal legal action.

Miscellaneous

  • Entire Agreement: These Terms and Conditions, together with the rental agreement signed at pickup, constitute the entire agreement between you and Valero regarding vehicle rental services.
  • Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Valero's failure to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision.
  • Assignment: You may not assign or transfer your rights under these terms without Valero's prior written consent.
  • Modifications: Valero reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified terms.
